On 27 November 2013, we signed a partnership agreement with a consortium of regional and local guarantee funds composing the National Guarantee Group (KGP).  Since January 2014, we have offered:

  • growth on attractive terms, with a low own contribution
  • financing available to entrepreneurs from 13 voivodships
  • source of finance for companies operating on the market for more than 12 months.

There are 21 regional and local guarantee funds operating as part of the National Guarantee Group, with a capital share of Bank Gospodarstwa Krajowego, representing 47% of the total number of funds operating in Poland.

The purpose of the Group is to work together on standardising services on the surety and guarantee market. In 2013, the Group adopted uniform rules of granting surety bonds for financing in the form of business lease.

Who is the business lease with a surety addressed to?

The offer „Business lease with a surety” targets micro, small and medium-sized enterprises (SME):

  • the micro, small and medium-sized enterprise category („SME”) includes enterprises with fewer than 250 employees, with an annual turnover of less than EUR 50 M and/or a annual balance sheet total lower than EUR 43 M,
  • therefore, in the SME category, a small enterprise is defined as one with fewer than 50 employees and an annual turnover or annual balance sheet total lower than EUR 10 M,
  • in the SME category, a micro enterprise is defined as one with fewer than 10 employees and an annual turnover or annual balance sheet total lower than EUR 2 M

What are the main provisions of the partnership agreement?

  • a surety is granted by a Fund from the relevant voivodship and exclusively to entrepreneurs having their registered office in that voivodship;
  • a surety is granted for obligations under business lease contracts, the object of which is intended solely for conducting business activity;
  • a surety is granted for the term of the business lease, extended by 6 months, not longer, however, than for 66 months, and in individual cases, for a period not longer than 126 months;
  • a surety is granted in PLN for up to 80% of the finance value defined as the initial value of the object of business lease, less the initial payment. For a business lease in a foreign currency, a surety shall be granted as the PLN equivalent as per NBP’s average exchange rate as at the lease contract signing date or as at the date of releasing the object of business lease;
  • a surety shall be granted upon the entrepreneur paying a commission to the Fund;
  • depending on the Fund, it will be possible to qualify requests for business lease surety as part of Jeremie (Joint European Resources for Micro-to-Medium Enterprises) – an initiative of non-subsidy support – to facilitate access to finance for micro-to-medium enterprises by offering dedicated financial engineering instruments to them. The proposed commission as part of JEREMIE initiative and de-minimis assistance  is a fee of PLN 100 (one-off fee) regardless of what percentage share of the transaction the surety represents and irrespective of the surety period. In all the other cases, a surety commission shall be charged by the Fund on a one-off basis, with its amount depending on the surety period and on the percentage range of the surety.
